It's imperative that employers understand how the Families First Coronavirus Response Act (FFCRA) impacts the rights of employees who may need to take leave if their children are home from school.

As a reminder, FFCRA permits eligible employees to take Emergency Paid Sick Leave (EPSL) and/or expanded family and medical leave (EFML) if they are unable to work or telework because they need to care for their son or daughter in the event that:
  • The child's school or place of care is closed
  • The childcare provider is unavailable, due to COVID-19-related reasons.
FFCRA regulations allow for an employee to take leave to care for their child only when the employee needs to, and actually is, caring for the child.

If you employed 20 or more employees for over half of the work-days in 2019, then you are subject to Federal-COBRA for ALL of 2020. If you employed 2-19 employees for over half of the work-days in 2019, then you are subject to Cal-COBRA.

 

Your COBRA status cannot change during the calendar year and is determined entirely by the number of persons you paid last year, not by the number of employees currently enrolled on your medical plans.

Employers providing prescription drug coverage to Part-D eligible individuals at the beginning of the plan year are required to provide an annual  online disclosure
to the Centers for Medicare & Medicaid Services (CMS) to report the creditable coverage status of their prescription drug plans. 

 

The disclosure form is due no later than 60 days after the beginning of a plan year-for calendar year plans beginning on January 1, 2019, this date would be March 1, 2019.

The law signed by Governor Brown expanding California's already stringent harassment prevention training requirements goes into effect on 
January 1, 2020. 
 
DRA Employee Benefit Clients have access to online Harassment Prevention Trainings and many other training courses at no cost. Administrators can arrange trainings and track completion. Participants receive a certificate of completion when applicable.
